This Privacy Policy was prepared by Joygame Oyun ve Teknoloji A.Ş (“Joygame”) with its headquarters at Aydınevler Mahallesi, Sanayi Caddesi, No.3 Centrum İş Merkezi Kat 5, Bölüm 502-503, Küçükyalı, Maltepe, İstanbul as the data controller in order to inform you about the methods of collection, processing, use, transfer and destruction of your personal data under Article 10 “Data Controller’s Disclosure Obligation” and Article 11 “Rights of the Data Owner” of the Personal Data Protection Law 6698 (“PDPL”).

Joygame shall process your personal data within the scope of the personal data processing conditions and purposes specified by the PDPL and

• in accordance with the law and the rules of honesty,
• by preserving the accuracy and most up-to-date version of the personal data you share,
• for specific, explicit and lawful purposes,
• in connection with the purpose for which they are to be processed, in a limited and measured manner,
• according to the conditions and purposes stipulated in the relevant legislation or as required by the purpose for which they are processed.

Collection of Personal Data, Processed Personal Data and Purpose

Collection. Your Personal Data are directly collected directly you during your visit to joygame.com website. In addition, Joygame directly receives data from you during your contact with the customer service. Your data are stored on the User Database (Payletter).

Processed Personal Data and Purpose.  Joygame processes, your username, email address and phone number

• to create a user database (payletter),
• to retrieve the account when the password is forgotten, and
• to ensure that the service is used to carry out customer service operations,

1. your computer’s features in order to provide optimization of the Game and to resolve technical issues to ensure the highest user experience,
2. your IP address in order to provide information to the prosecutor and other judicial authorities in cases of fraud, including theft of your user account.

Information for Mobile Applications

No personal data is transferred to Joygame when you download mobile games published by Joygame, while using mobile games or make in-game purchases in mobile games. All of your purchases or downloads and usage transactions are completed through the Apple AppStore and GooglePlay app stores.

Even in the presence of your explicit consent for personalized advertisements, Joygame and its suppliers process the transactions or activities you carry out on the application and your reactions to the advertisements anonymously.

Joygame, works with third parties to provide Joygam with analytical, analysing, storage, advertising and marketing services. You can access to the list of our business partners and service providers and their own privacy policy’s through the table below.

Joygame shall only be able to send notifications to the device you connect to the games through the games upon your explicit consent. At this stage, no personal data is processed by Joygame. You can change the notification settings on your device at any time.

We use Google Analytics, a web analytics service, on our website. In other words, your browsing behavior may be analyzed statistically and especially by using cookies and analysis software when you visit our website. Your browsing behavior is generally analyzed anonymously and is not used to track you. You can object to this type of analysis without using specific tools, or you can prevent this type of analysis.

Google Analytics is provided by Google LL, registered at 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA.

Legal Grounds for Data Processing

Data processing is used for reasons expressly provided by the following in order to benefit from and purchase Joygame games, provide customer service and support;

• for legal purposes under sub-paragraph (a) of PDPL,
• if it is directly related to the establishment or performance of the contract under sub-paragraph (c),
• if it is mandatory for Joygame to fulfill its legal obligations as the data controller under sub-paragraph (ç),
• if it is necessary to establish, protect and exercise a right of Joygame pursuant to sub-paragraph (e).

The processing of these data is not subject to your consent. In this respect, we inform you that you do not have the right to request the deletion or destruction of your personal data until the end of the retention periods required by the service you use or the law.

Processing Based on Your Explicit Consent

Joygame.com membership.  During your membership to Joygame.com, you will be offered the option to share your profile photo, name and surname, educational status, date of birth, occupation, TR ID number, city of residence, country, your GSM operator, telephone number and your address with us. However, it is entirely at your choice and discretion whether to share this information with us or not. Not sharing this information will not prevent you from playing or purchasing the Joygame game.

The purpose of requesting this information is to create user database (payletter) records.  The user database is used to control disputes related to payment and to manage customer relations.

If, during your membership to Joygame.com, you declare your personal data specified here and check the box on the relevant web page regarding the consent statement, you will give Joygame your explicit consent to process this data for the purposes specified here. In this case, Joygame will process your personal data referred to in this paragraph based on your explicit consent in accordance with Article 5/1 of the PDPL.

Marketing and advertising purposes.  Your name, surname, e-mail address and mobile phone number requested from you during your membership at Joygame.com may also be processed for the purpose of communicating with you if you have given us your explicit consent. The processing of your data in order to carry out commercial communication activities, including providing information about new games and promotions, is based on your explicit consent in accordance with Article 5/1 of the PDPL.

You can give your explicit consent for commercial communication when signing up to joygame.com.

You can always withdraw your explicit consent to the processing of your personal data for the purposes set out herein.  Withdrawing your consent will not affect the legality of processing based on your consent prior to such withdrawal. The information provided prior to the withdrawal of your consent will be retained for the specified retention periods.

Automatic decision-making systems shall be used by using your data obtained from social media channels such as your Facebook records and Instagram preferences, which are made public by you.

Transfer of Personal Data to Third Parties

In order to comply with the obligations arising from the law and/or to fulfill its responsibilities arising from the service and purchase contract or if it is necessary in order to fulfill its legal obligation and/or to establish, exercise or protect a right, Joygame may, without the need for your consent, transfer your personal data

1. to third parties, in particular technical support units within Joygame, and to other third parties such as banks, audit firms, lawyers, attorneys’ offices, financial advisors and suppliers, as required by the work and/or those it receives service from, limited to and proportionate to the service received solely for the performance of obligations, and
2. to the police units, judicial authorities, relevant ministries and directorates and other public institutions authorized by law.

The transfer of data within Turkey shall be limited to the cases where it is mandatory by law in accordance with sub-paragraph (a), for the establishment and/or performance of the contract in accordance with sub-paragraph (c), for the fulfillment of a legal obligation in accordance with sub-paragraph (ç) and for the establishment, use or protection of a right in accordance with sub-paragraph (e) of Article 8/2 (a) of the PDPL.

Information about third parties and /or categories of third parties to whom your data is disclosed in Turkey is always available for your information and review.

Access to Personal Data from Abroad

Joygame stores personal data on its servers in Turkey. However, Neo Softnyx in South Korea own the desktop game you play on joygame.com. Therefore, Neo Softnyx may occasionally access your e-mail address stored on servers in Turkey and the technical specifications of the computer you are playing the game on in order to solve and manage systemic problems. Such access is based on your explicit consent obtained from you through the website. Your explicit consent’s legal basis is Article 9/1 of PDPL.

Protection, Retention Period and Destruction of Personal Data

Joygame is obliged to take all kinds of physical, technical and administrative measures to ensure an adequate level of security in order to prevent unlawful processing of, unlawful access to your personal data, and to ensure the protection of your personal data, and takes these measures to the maximum extent.

Your personal data are stored for ten (10) years from the last date your user account was active and your personal data processed for purchasing transactions are stored for ten (10) years from the last purchase date until the end of the retention period.

The processing of your personal data for marketing purposes is limited to two (2) years following the last date you were active on Joygame.com. Joygame will not use your personal data to contact you for marketing purposes after a period of two (2) years.

At the end of these periods, your personal data will be deleted, destroyed or anonymized during the first disposal period.

Joygame has prepared separate specific information texts (clarification text) for users, employees, employee candidates, suppliers and managers. These clarification texts have been delivered to the related persons or access has been provided.

Your Rights

As the data owner, you have (a) the right to request information about whether your personal data are processed and how they are processed (Article 11/(a), (b)), (b) to learn the purpose of processing and whether they are used in accordance with the purpose (Article 11/c), (c) to know the third parties to whom they are transferred (Article 11/ç) (d), to request correction (Article 11/d), (e) to request the deletion of your personal data in case the reasons for processing are eliminated (Article 7, Article 11/e), (f) to request the notification of the relevant transactions to the third parties to whom your personal data is transferred (Article 11/f), (g) to object to the results obtained as a result of analysis of your data (Article 11/g), (h) to request the limitation of processing (Article 7/g), (i) to request the compensation of the damage suffered in case of unlawful processing (Article 11/ğ).

Your aforementioned rights are limited to the law and may only be granted by us under certain circumstances. (Please refer in particular to Articles 10 and 13 of the PDPL). You can forward these requests listed above to e-mail address.

Bu Gizlilik Politikası veri sorumlusu sıfatıyla merkezi Aydınevler Mahallesi, Sanayi Caddesi, No.3 Centrum İş Merkezi Kat 5, Bölüm 502-503, Küçükyalı, Maltepe, İstanbul adresinde bulunan Joygame Oyun ve Teknoloji Anonim Şirketi (“Joygame”) tarafından  6698 Sayılı Kişisel Verilerin Korunması Kanunu (“KVKK”) kapsamında kişisel verilerin işlenmesine ilişkin ‘Veri Sorumlusunun Aydınlatma Yükümlülüğü’ başlıklı 10. maddesi ve ‘İlgili Kişinin Hakları’ başlıklı 11. maddesi çerçevesinde, kişisel verilerinizin toplanma yöntemleri, işlenmesi, kullanılması, aktarılması, imha edilmesi konularında tarafınıza bilgi vermek maksadıyla hazırlanmıştır.

Joygame, kişisel verilerinizi KVKK ile belirtilen kişisel veri işleme şartları ve amaçları dahilinde

Kişisel Verilerin Toplanması,  İşlenen Kişisel Veriler ve Amacı

Toplama. Tarafınıza ait Kişisel Veriler, joygame.com ve joygamestore.com web sitelerine ziyaretiniz sırasında ve doğrudan sizlerden toplanmaktadır. Ayrıca, Joygame müşteri hizmetleri ile kurduğunuz iletişim sırasında yine doğrudan sizlerden alınmaktadır. Verileriniz Kullanıcı Veri Tabanı (Payletter) üzerinde saklanmaktadır.

İşlenen Kişisel Veriler ve Amacı.  Joygame,

1. kullanıcı adınızı, e.posta adresinizi ve telefon numaranızı

•  Joygamestore.com adresinde kullanıcı oluşturmak,
•  Kullanıcı veri tabanı (payletter) oluşturmak,
•  şifre unutulduğu zaman hesabı geri almak,  ve
• müşteri hizmetleri işlemlerini yürütmek amacıyla hizmetten yararlanılmasını sağlamak üzere,

2. ad ve soyadınızı, T.C.kimlik numaranızı ve adresinizi Joygamestore.com üzerinden yapılan satınalma işlemlerinde kanun gereği, sözleşmenin ifası ve hukuki yükümlülüklerin yerine getirilmesi amacıyla, işlenmektedir.
3. bilgisayar özelliklerinizi en üst kullanıcı deneyimini sağlamak üzere Oyun’un optimizasyonunu sağlamak ve teknik sorunları çözmek amacıyla
4. IP adresinizi kullanıcı hesabınınn çalınması  dahil  sahtecilik dolandırıcılık vakalarında savcılığa ve diğer adli mercilere bilgi sağlamak  amacıyla

işlemektedir.

Web Sitemizde bir web analiz servisi olan Google Analytics’i kullanmaktayız. Bir diğer ifade ile web  sitemizi ziyaret ettiğiniz zaman, tarama davranışınız istatistiki olarak ve özellikle çerezler ve analiz yazılımı kullanmak suretiyle analiz edilebilecektir. Tarama davranışınız genel olarak anonim olarak analiz edilmektedir ve sizi izlemek için kullanılmamaktadır. Belirli aletleri kullanmaksızın bu türden bir analize itiraz edebilirsiniz veya bu türden bir analizi önleyebilirsiniz.

İşlemenin Dayandığı Hukuki Sebepler

Veri işleme,  Joygame oyunlarından yararlanılması, satın alınması, müşteri hizmetleri ve desteğinden yararlanılması amacıyla KVKK’nın  5/2  maddesinin

• (a) bendi uyarınca kanunlarda açıkça öngörülen sebeplere,
• (c) bendi uyarınca sözleşmenin kurulması veya ifasıyla doğrudan doğruya ilgili olarak zorunlu olmasına,
• (ç) bendi uyarınca veri sorumlusu sıfatıyla Joygame’in hukuki yükümlülüklerini yerine getirebilmesi için zorunlu olmasına, ve
• (e) bendi uyarınca Joygame’in bir hakkını tesis, korumak ve kullanmak için zorunlu olması haline

dayanmaktadır.

İşbu verilerin işlenmesi rızanıza tabi değildir. Bu itibarla yararlanılan hizmetin ve yasanın gerektirdiği muhafaza sürelerinin sonuna kadar kişisel verilerinizin silinmesini veya yok edilmesini talep etme hakkına haiz olmadığınızı belirtiriz.

Mobil Uygulamalara İlişkin Bilgilendirme

Joygame’in yayımladığı mobil oyunları indirdiğinizde, mobil oyunları kullanırken veya mobil oyunlarda yaptığınız oyun içi satın alımlarda Joygame’e hiçbir kişisel veriniz aktarılmamaktadır. Satın alma işlemleriniz veya indirme ve kullanıma ilişkin işlemlerinizin tamamı Apple AppStore ile GooglePlay uygulama mağazaları aracılığıyla gerçekleştirilmektedir.

Kişiselleştirilmiş reklamlara ilişkin açık onayınızın varlığı halinde dahi Joygame ve tedarikçileri, uygulama içerisinde gerçekleştirdiğiniz işlemleri ve size gösterilen reklamlara verdiğiniz tepkileri anonim olarak işleyecektir.

Joygame, kendi adına analitik, analiz, barındırma, reklam, pazarlama ve benzeri hizmetler için üçüncü kişi tedarikçilerle çalışmaktadır. Bu üçüncü kişi hizmet sağlayıcılarımız ve iş ortaklarımızın listesi ve kendi gizlilik politikalarına aşağıdaki tablodan erişebilirsiniz:

Joygame, ancak açık onayınızın bulunması halinde oyunlar üzerinden oyunlara bağlandığınız aygıta bildirimler gönderebilecektir. Bu aşamada da Joygame tarafından herhangi bir kişisel veriniz işlenmemektedir. Bildirim ayarlarını dilediğiniz zaman aygıtınızın üzerinden değiştirebilirsiniz.

Açık Rızanıza Dayalı İşleme

Joygame.com üyeliği. Joygame.com üyeliğiniz sırasında sizlere profil fotoğrafınızı, ad ve soyadınızı,  eğitim durumunuzu, doğum tarihinizi, mesleğiniz, T.C. kimlik numaranızı, ikamet ettiğiniz şehri, ülkeyi, kullandığınız gsm operatörünü, telefon numaranız ve adresinizi bizimle paylaşma seçeneği sunulmaktadır. Bununla birlikte, bu bilgileri bizimle paylaşıp paylaşmamak tamamen sizin tercihizde ve takdirinizdedir. Sözkonusu bilgileri paylaşmamanız Joygame oyununu oynamanıza veya oyun satın almanıza engel olmayacaktır.

Bu bilgileri talep etmemizdeki amaç kullanıcı veri tabanı (payletter) kayıtları oluşturmaktır.  Kullanıcı veri tabanı ödeme ile ilgili uyuşmazlıkların kontrolünü sağlamak ve müşteri ilişkilerini yönetmek üzere kullanılmaktadır.

Joygame.com üyeliğiniz sırasında burada belirtilen kişisel bilgilerinizi beyan etmeniz ve ilgili web sayfasında rıza beyanına ilişkin kutucuğu işaretlemeniz halinde Joygame’e bu bilgileri burada belirtilen amaçlarla işlemek üzere açık rıza vermiş olacaksınız. Bu halde, Joygame bu paragrafta belirtilen kişisel verilerinizi KVKK madde 5/1 uyarınca açık rızanıza dayanarak işleyecektir.

Pazarlama ve reklam amaçlı iletişim.  Joygame.com üyeliğiniz sırasında sizden talep edilen adınız soyadınız, e.posta adresiniz ve cep telefonu numaranız açık rızanızın varlığı halinde sizinle ticari iletişim kurmak amacıyla da işlenebilir. Verilerinizin  yeni oyunlara, promosyonlara ilişkin bilgi vermek dahil ticari iletişim faaliyetlerini yürütmek üzere işlenmesi KVKK madde  5/1 uyarınca açık rızanıza dayanmaktadır.

Ticari iletişim için açık rızanızı joygame.com adresine üye olurken verebilirsiniz.

Kişisel verilerinizin burada belirtilen amaçlarla işlenmesi hususundaki açık onayınızı her zaman geri alabilirsiniz. Onayınızı geri çekmeniz, bu geri çekmeden önce onayınıza dayanarak yapılan işlemenin hukuka uygunluğunu etkilemeyecektir. Onayınızın geri çekilmesinden önce sağlanan bilgiler belirtilen saklama süreleri boyunca muhafaza edilecektir.

Sizler tarafından aleni hale getirilen facebook kayıtlarınız, instagram tercihleriniz gibi sosyal medya mecralarından elde edilebilen verileriniz dikkate alınarak otomatik karar verme sistemleri  kullanılmaktadır.

Kişisel Verilerin  Üçüncü Şahıslara Aktarımı

Joygame, kanundan doğan yükümlülüklere uymak ve/veya hizmet ve satınalma  sözleşmesi gereğince sorumluluklarını ifa etmek için, hukuki yükümlülüğünü yerine getirebilmesi ve/veya bir hakkını tesis etme, kullanma veya koruma  için zorunlu olması halinde rızanıza ihtiyaç olmadan

1. sadece yükümlülüklerin yerine getirilmesi için alınan hizmetle sınırlı ve bu amaçla orantılı olarak Joygame içindeki teknik destek birimleri başta olmak üzere ilgili birimler, bankalar, denetim firmaları, avukatlar, avukatlık ofisleri, mali müşavirler ve tedarikçiler gibi işin gerektirdiği ve/veya hizmet aldığı üçüncü şahıslara, ve
2. emniyet birimleri, adli merciler,  ilgili bakanlıklar ve müdürlükler ile  kanunlarla yetkili kılınan diğer kamu kurumlarına

aktarabilir veya açıklayabilir.

Türkiye içerisindeki veri aktarımı KVKK’nın 8/2(a) bendine istinaden KVKK 5/2 (a) uyarınca kanun gereği, (c) uyarınca sözleşmenin kurulması ve/veya ifası için zorunlu olması, (ç) uyarınca hukuki bir yükümlülüğün yerine getirilmesi ve (e) uyarınca bir hakkın tesisi, kullanılması veya korunması için zorunlu olması halleri ile sınırlı olacaktır.

Türkiye’de verilerinizin açıklandığı üçüncü kişilere ve /veya üçüncü kişi kategorilerine ilişkin bilgi her zaman bilginize ve incelemenize açıktır.

Kişisel Verilerin Yurtdışından Erişimi

Joygame kişisel verilerini Türkiye’deki sunucularda saklamaktadır. Ancak, joygame.com üzerinden oynadığınız ve joygamestore.com üzerinden satın aldığınız oyunların sahibi Güney Kore’deki Neo Softnyx, Netmarble şirketleridir. Bu sebeple, sistemsel sorunların çözülmesi ve yönetilmesi için zaman zaman Neo Softnyx ve Netmarble Türkiye’deki sunucularda saklanan e.posta adresinize ve oyun oynadığınız bilgisayarın teknik özelliklerine erişebilmektedir. Sözkonusu erişim, web sitesi üzerinden sizden açık bir şekilde alınan rızanıza dayanmaktadır. Açık rızanızın hukuki dayanağı KVKK m.9/1 hükmüdür.

Kişisel Verilerin Korunması, Saklama Süresi ve İmhası

Joygame,  kişisel verilerinizin hukuka aykırı olarak işlenmesini, kişisel verilerinize hukuka aykırı olarak erişilmesini önlemek ve kişisel verilerinizin muhafazasını sağlamak amacıyla yeterli güvenlik düzeyini temin etmeye yönelik her türlü fiziksel, teknik ve idari tedbirleri almakla yükümlüdür ve bu tedbirleri azami ölçüde almaktadır.

Kişisel verileriniz kullanıcı  hesabınızın son aktif olunan tarihten   itibaren on (10) yıllık; satınalma işlemleri için işlenen kişisel verileriniz ise son satınalma  tarihinden itibaren on (10) yıllık saklama süresinin sonuna kadar saklanmaktadır.

Kişisel verileriniz pazarlama amacıyla işlenmesi Joygame.com  veya joygamestore.com sitelerinde son aktif olduğunuz en son tarihi müteakip  iki (2) yıllık süre ile sınırlıdır. Joygame, iki (2) yıllık süre sonunda kişisel verilerinizi pazarlama amacıyla sizinle iletişime geçmek üzere kullanmayacaktır.

Bu sürelerin sonunda ilk imha periyodunda kişisel verileriniz silinecek, yok edilecek veya anonim hale getirilecektir.

Joygame, kullanıcılar, çalışanlar, çalışan adayları, tedarikçiler ve yöneticilerine yönelik  ayrı özel bilgilendirme metinleri (aydınlatma metni) hazırlamıştır. Bu aydınlatma metinleri her ilgili kişi grubuna ulaştırılmış veya erişim yetkisi verilmiştir.

Haklarınız

Veri sahibi olarak yürürlükteki mevzuat uyarınca Kişisel verilerinizin (a) işlenip işlenmediğini ve ne şekilde işlendiği hakkında bilgi talep etmek(m. 11/(a), (b)), (b) işlenme amacını ve bunların amacına uygun kullanıp kullanılmadığını öğrenme (m. 11/c), (c) aktarıldığı üçüncü kişileri bilme (m. 11/ç) (d)  düzeltilmesini isteme (m. 11/d), (e) İşlenmesini gerektiren sebeplerin ortadan kalkması hâlinde kişisel verilerinizin silinmesini isteme (m.7, m. 11/e), (f)  düzeltilmesi ve silinmesi halinde ilgili işlemlerin kişisel verilerinizin aktarıldığı üçüncü kişilere bildirilmesini isteme (m.11/f), (g) analiz edilmesi sonucunda elde edilen sonuçlara itiraz etme  (m 11/g), (h) İşlenmesinin sınırlanmasını talep  (m.7), (ı) kanuna aykırı olarak işlenmesi sebebi ile zarara uğranılması halinde zararın giderilmesini isteme (m.11/ğ) hakkına sahipsiniz.

Yukarıda anılan haklarınız yasa ile sınırlandırılmıştır ve tarafımızca muhtemelen ancak belirli koşullar dahilinde sağlanabilecektir. (Lütfen özellikle KVKK’nın 10. ve 13. maddelerini inceleyiniz). Yukarıda sayılan bu taleplerinizi [email protected] e-posta adresine iletebilirsiniz. Joygame, talebinizi talebin ve  gerekli belgelerin ulaşmasından itibaren en kısa sürede ve en geç 30 (otuz) gün içinde sonuçlandıracaktır.
